The 2018 Farm Bill, also known as the Agriculture Improvement Act, stipulates that all derivatives, isomers, and cannabinoids found in hemp are legal, as long as the final product contains less than 0.3% Delta-9-THC. 

Despite being federally legal, Delta-8-THC remains prohibited in some states that have specifically excluded it and other hemp-derived cannabinoids.

Delta-8 is legal in the following states:

  • Alabama
  • Arkansas
  • Florida
  • Georgia
  • Hawaii
  • Illinois
  • Indiana
  • Kansas
  • Kentucky
  • Louisiana
  • Maine
  • Maryland
  • Massachusetts
  • Minnesota
  • Missouri
  • Nebraska
  • New Hampshire
  • New Jersey
  • New Mexico
  • North Carolina
  • Ohio
  • Oklahoma
  • Oregon
  • Pennsylvania
  • South Carolina
  • South Dakota
  • Tennessee
  • Texas
  • Virginia
  • West Virginia
  • Wyoming
  • Washington D.C.

Delta-8 is regulated/unclear in the following states:

  • California
  • Connecticut
  • Michigan
  • Mississippi
  • Wisconsin

Delta-8 is illegal in the following states:

  • Alaska
  • Arizona
  • Colorado
  • Delaware
  • Idaho
  • Iowa
  • Montana
  • Nevada
  • New York
  • North Dakota

  • Vermont
